1. Acceptance of Terms

By creating an account or using AdvocateNow, you agree to these Terms. If you do not agree, do not use the platform. These Terms constitute a binding legal agreement between you and AdvocateNow LLC.

2. Not Medical Advice

AdvocateNow is an informational and educational platform only. Nothing on this platform, including AI-generated analyses, summaries, alerts, questions, or any other content, constitutes medical advice, medical diagnosis, or a recommendation for any specific treatment, medication, or clinical decision. AdvocateNow is not a licensed medical provider, and use of this platform does not create a patient-provider relationship of any kind. Always consult a licensed physician or qualified healthcare professional before making any medical decision.

3. Emergency Situations

AdvocateNow is not intended for emergency or urgent medical situations. If you believe you or someone else may be experiencing a medical emergency, call 911 or seek immediate medical attention. Do not use this platform as a substitute for emergency care.

4. Not a Medical Device

AdvocateNow is a software information service. It is not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease. It is not a medical device as defined by the FDA and has not been reviewed, cleared, or approved by the FDA or any similar regulatory authority.

5. Accuracy Disclaimer

AI-generated analyses may contain errors, omissions, or inaccuracies. Medical records are complex and automated analysis cannot replace clinical judgment. AdvocateNow makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for any purpose of any analysis generated on the platform. You assume full responsibility for how you use information provided by AdvocateNow.

6. Your Responsibility for Uploaded Content

By uploading any document, file, or record to AdvocateNow, you represent and warrant that: (a) you are the patient or are legally authorized to access and share the records on behalf of the patient; (b) you have obtained any required consent from the patient if you are acting on their behalf; (c) you will not upload records belonging to a person for whom you have no legal authority. You agree to indemnify AdvocateNow LLC for any claims arising from your unauthorized use of another person's medical records.

7. Not Covered by HIPAA

AdvocateNow is not a healthcare provider, health plan, or healthcare clearinghouse and is therefore not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). While HIPAA may not apply to AdvocateNow, we take reasonable measures to protect your data as described in our Privacy Policy.

8. Privacy and Data Use

Your use of the platform is governed by our Privacy Policy, incorporated here by reference. Uploaded records are processed via third-party AI infrastructure (Anthropic API) solely to generate your analysis. Records are not sold, shared with advertisers, or used to train AI models.

9. No Guarantee of Outcomes

AdvocateNow does not guarantee any specific health outcome, clinical result, or quality of care as a result of using the platform. The platform is intended to help families ask better questions and understand medical records; it does not guarantee that those questions will change care or improve outcomes.

10. Service Availability

AdvocateNow does not guarantee uninterrupted or error-free access to the platform and may modify, suspend, or discontinue the service at any time without notice or liability.

11. Limitation of Liability

To the maximum extent permitted by law, AdvocateNow LLC, its founders, employees, and contractors shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the platform, including but not limited to reliance on AI-generated analysis, medical decisions made based on platform content, or unauthorized access to your data. Your sole remedy for dissatisfaction with the platform is to stop using it.

12. Indemnification

You agree to defend, indemnify, and hold harmless AdvocateNow LLC from any claims, losses, or expenses (including attorney fees) arising from your use of the platform, your violation of these Terms, or your unauthorized upload of another person's medical records.

13. Subscription and Cancellation

AdvocateNow is offered on a weekly subscription basis. Subscriptions automatically renew unless canceled prior to the next billing cycle. You may cancel at any time from your account settings. Cancellation stops future charges but does not entitle you to a refund of the current billing period. All payments are processed by Stripe.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration rather than court proceedings, except where prohibited by applicable law. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the courts of Palm Beach County, Florida.

16. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance. We will notify active users of material changes by email.
